4. Orders and Payment

When you place an order, you make an offer to purchase the products subject to these Terms. We reserve the right to accept or reject orders at our sole discretion. Order acceptance is confirmed when we send an order confirmation email.

4.2 Pricing and Availability

All prices are displayed in the currency indicated and are subject to change without notice. We strive to ensure accuracy but errors may occur; we reserve the right to correct pricing errors and cancel orders placed at incorrect prices. Product availability is subject to change.

4.3 Payment

You agree to pay all fees and charges associated with your order at the rates in effect when the charges are incurred. We accept payment methods as displayed on the Platform. By providing payment information, you represent that you are authorized to use the chosen payment method.

4.4 Taxes

8. Disclaimers

8.1 Products

THE PRODUCTS ARE PROVIDED "AS IS" FOR RESEARCH USE ONLY. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS' FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PRODUCTS WILL MEET YOUR SPECIFIC RESEARCH REQUIREMENTS.

8.2 Platform

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • ETHICAL PEPTIDES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
  • WE SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE PLATFORM, UNAUTHORIZED ACCESS TO YOUR DATA, OR ANY THIRD-PARTY CONDUCT

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless Ethical Peptides, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any dispute between you and a third party.

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

12. Modifications

Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform.

13. General Provisions

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Ethical Peptides regarding the Platform and supersede any prior agreements.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ethical Peptides operates, without regard to its conflict of law provisions.

13.5 Dispute Resolution

Any disputes arising from these Terms or the Platform shall be resolved through binding arbitration or the courts of our jurisdiction, as applicable. You agree to submit to the personal jurisdiction of such courts.
